Terms of use

This is a convenience translation. Only the German version is legally binding.

MailBridge depends on the delivery reputation of its infrastructure. That reputation is what you pay for. These rules protect it. In short: send what your recipients expect, and we make sure it arrives.

1. Scope

MailBridge is an SMTP relay service of LOGIN SystemHaus GmbH, Hagenauer Str. 55, 65203 Wiesbaden (hereinafter “we”). These terms of use apply to all contracts for the use of MailBridge. The offering is directed exclusively at businesses (entrepreneurs within the meaning of Section 14 of the German Civil Code, BGB), legal entities under public law and special funds under public law (öffentlich-rechtliche Sondervermögen), not at consumers.

2. Service and intended use

MailBridge accepts your emails via SMTP and delivers them through our infrastructure. The intended use is sending:

  • transactional emails from your software and your devices, such as invoices, receipts, order confirmations, system notifications, scans and alerts,
  • newsletters and mailings to recipients who have consented to receiving them or with whom a business relationship within the meaning of § 7(3) of the German Unfair Competition Act (Gesetz gegen den unlauteren Wettbewerb, UWG) exists.

MailBridge is not a tool for unsolicited advertising. Anyone who wants to send spam is in the wrong place.

3. Prohibited use

The following may not be sent or operated through MailBridge:

  • unsolicited advertising emails (spam) and mailings to purchased, rented or automatically harvested address lists,
  • phishing, malware, fraudulent, defamatory or otherwise unlawful content,
  • forged sender information or headers, impersonation, and sending through domains you are not authorized to use,
  • passing on or reselling your credentials to third parties, and operating the service as an open relay,
  • circumventing technical limits, or actions that impair our infrastructure or the deliverability of other customers.

4. Obligations when sending newsletters

If you send newsletters or other mailings to many recipients, the following also applies:

  • You must be able to prove the consent of every recipient; you must use a double opt-in process for sign-ups.
  • Every mailing must contain a working unsubscribe option and the sender information required by law.
  • You must maintain your recipient list: you process unsubscribes without undue delay and remove permanently undeliverable addresses (bounces).

5. Credentials and security

Your SMTP credentials must be kept secret and protected against access by unauthorized persons. If there is any suspicion that credentials have been compromised, you must inform us without undue delay; you can reset the password in the portal at any time. You are responsible for any sending carried out with your credentials until you have reported a compromise to us.

6. Quotas and fair use

The volume of sending is determined by the plan you have booked (see Pricing). We automatically charge for overages in extra packs of 1,000 emails each at the price applicable at the time. If the overage exceeds 100 % of the booked monthly volume (but no less than two extra packs), we pause further sending until you release additional volume in the portal or book a larger plan. Unused quotas expire at the end of the month. We may technically limit sending (e.g., through rate limits) to the extent necessary to protect the infrastructure and the delivery reputation.

7. Measures in the event of violations

Violations of these terms endanger the deliverability of all customers. That is why we act in stages, but consistently: notice, throttling, temporary suspension, extraordinary termination. In the event of serious violations (in particular spam, phishing or malware), we may suspend sending immediately and without prior notice. A justified suspension does not affect your payment obligation for the current billing period.

8. Availability

We operate MailBridge with reasonable care and aim for high availability. Where possible, we announce maintenance windows in advance. We have no control over whether third-party receiving mail servers accept an email; we do not guarantee delivery in any individual case.

9. Liability and indemnification

We are liable without limitation for intent and gross negligence, and for injury to life, body and health. In the case of simple negligence, we are liable only for breaches of material contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

If you violate these terms of use, you indemnify us against any resulting third-party claims and reimburse us for the expenses incurred, including the expenses for removing our systems from blacklists, insofar as the listing is due to your violation.

10. Term and termination

The contract runs on a monthly basis and renews automatically for one month at a time. Either party may terminate it in text form (email is sufficient) effective at the end of the current billing period. The right to extraordinary termination for good cause remains unaffected.

11. Final provisions

Our privacy policy applies to the processing of personal data. Where we process personal data on your behalf with MailBridge, the data processing agreement (DPA, German AVV) applies in the version provided in the customer portal; it applies upon conclusion of the contract. In the portal, under “Data protection & DPA”, you can complete it with your company details and download it with our signature and our technical and organisational measures. We announce changes to these terms of use in text form at least four weeks before they take effect; if you do not object before they take effect, they are deemed accepted. We point this out separately in the announcement. German law applies. The place of jurisdiction is Wiesbaden. Should individual provisions be invalid, the remainder of the contract remains valid.
